Data Privacy Statement concerning our mobile app SelfCheck and Livestreaming

1 Information about the collection of personal data

(1) We make a mobile app available to you which you can download to your mobile terminal device. We inform you below about the collection of personal data when using the mobile app. Mobile data are all data which can refer to you personally, such as name, address, email address, user behaviour.

2. Collection of personal data when using our mobile app

(1) At the downloading of the mobile app the necessary information is transmitted to the app store including, more particularly, the user name, email address and customer number of your account, the time of the download and the individual device code. We do not have any influence on this data collection and are not responsible for it. We process the data only to the extent that it is necessary for your downloading of the mobile app to your terminal device.

(2) If the mobile app is used, we collect the following personal data to permit a comfortable use of the functions of our mobile app and ensure stability and security.

• The operating system of the user / mobile device and the corresponding version
• The manufacturer and model designation of the mobile device
• The version of the app used
• The type of access (WLAN, mobile phone, etc)
• Country code and name of the mobile phone operator
• Date and time of access

If the help function in the app is used, the data entered by the user under this function are stored on top:

• Name
• Email address
• Contact number (telephone)

These data are likewise stored in the log files of our system. A storage of these data together with other personal data of the user does not take place. The legal basis for the temporary storage of the data is Art. 6 Para 1 lit. f GDPR.

(3) Within the framework of the app you can enter, manage and process different information, tasks and activities. This information includes, more particularly, data about the images or videos collected through the app as well as the times recorded by the user.

Moreover, the app requires the following authorisations:

• Internet access: the latter is needed to transmit the collected data through an encoded connection to our servers. A unique key is used as an identification feature which can only be allocated to the respective user on the server side. To do this, an automatic service is used which checks at periodic intervals during the term of the apps whether data must be transmitted and transmits them if necessary.
• Camera access: the latter is needed to create order-related images or videos of objects.
• GPS: these data (longitudes and latitudes) are needed to record the site of the objects in the images or videos.
• The data are made available to a processor within the framework of an order placed with the latter.

3. Erasure and blocking of personal data

The person in charge of processing processes and stores personal data only during the period which is necessary to reach the purpose of the storage or if this is provided for by the European issuer of directives and regulations or any other legislator in laws or provisions to which the person in charge of processing is subject.

If the purpose of storage no longer exists or if a storage period provided for by the European issuer of directives and regulations or any other competent legislator expires, the personal data are blocked or erased in accordance with the legal provisions.

4. Your rights

If personal data relating to you are processed, you are a data subject within the meaning of GDPR and you have the following rights vis a vis the controller:

1. According to Art. 15 GDPR you have the right to obtain information to the extent mentioned therein about the personal data processed by us;
2. In accordance with Art. 16 GDPR you have the right to demand immediately the rectification of inaccurate personal data stored by us or a completion of such data;
3. In accordance with Art. 17 GDPR you have the right to demand the erasure of the personal data stored by us unless the further processing is necessary
   - for the exercise of the right to a free expression of opinion;
   - to fulfil a legal obligation;
   - for reasons of public interest; or
   - to assert, exercise or defend legal claims;
4. In accordance with Art. 18 GDPR the right to restrict the processing of your personal data to the extent that
   - the accuracy of the data is contested by you;
   - the processing is unlawful but you oppose their erasure;
   - the data is no longer needed but you need them for the establishment, exercise and defence of legal claims; or
   - you have objected to the processing in accordance with Art. 21 GDPR;
5. In accordance with Art. 20 GDPR you have the right to receive your personal data which you have made available to us in a structured, commonly used and machine-readable format or demand the transmission to another controller;
6. In accordance with Art. 77 GDPR you have the right to lodge a complaint with a supervisory authority. As a rule, you can address such complaint to the supervisory authority of your habitual residence or place or work or the registered office of our company.
7. Right of objection
   You have the right for reasons which result from your particular situation to oppose the processing of personal data relating to you which is made in accordance with Art. 6 Para 1 lit. e or f GDPR; this also applies to any profiling based on these provisions.
   
   The controller no longer processes the personal data relating to you unless he can prove coercive protectable reasons for the processing which prevail over your interests, rights and freedoms or if the processing serves the assertion, exercise or defence of legal claims.
   
   If personal data relating to you are processed for the purpose of direct marketing, you have the right to oppose at any time the processing of the personal data relating to you for the purpose of such marketing; this also applies to profiling insofar as it is related to such marketing.
   
   If you oppose the processing for the purpose of marketing, the personal data relating to you will no longer be processed for these purposes.
   
   In connection with the use of services of the information society you have the possibility to exercise your right to object – regardless of Directive 2002/58/EC - through automated processes during which technical specifications are used.
   
   
8. Right to withdraw the declaration of consent under data protection law
   You have the right to withdraw your declaration of consent under data protection law at any time. Any withdrawal of the consent does not affect the lawfulness of the processing made by virtue of the consent until the withdrawal.
